Terms of Service – DiskCrafters

1. Acceptance of Terms

By accessing or using the DiskCrafters Shopify store or any related services, you agree to be bound by these Terms of Service and all applicable laws and regulations.

If you do not agree with these Terms, you must not use our services.

2. Description of Services

DiskCrafters provides CD printing, duplication, replication, and related manufacturing services.

We do not provide legal advice, copyright clearance, licensing verification, or intellectual property review services.

3. Independent Service Provider

DiskCrafters operates solely as an independent service provider. Nothing in these Terms creates any partnership, agency, joint venture, or distribution relationship between DiskCrafters and any customer.

4. Ordering and Payment

You must provide accurate and complete information when placing an order.

By placing an order, you authorise payment for the full amount using your selected payment method.

All prices are in GBP (£) and may be changed at any time without notice.

5. Processing Times

Estimated processing time is typically 1–6 weeks, depending on workload, order complexity, and production requirements.

Processing times are estimates only and not guaranteed.

6. Shipping and Delivery

Delivery times are estimates and may vary depending on location and third-party carriers.

DiskCrafters is not responsible for delays caused by shipping providers.

7. Refunds and Returns

All sales are final.

Refunds & Replacements are only provided where required by law or where an error has occurred directly due to DiskCrafters.

Issues must be reported within 7 days of receiving your order.

8. Customer Responsibility – Intellectual Property

By submitting any content (“Materials”), including but not limited to audio, artwork, images, text, logos, designs, or data, you confirm and warrant that:

8.1 Ownership and Rights

You either:

Own all necessary rights in the Materials; or
Have obtained all necessary licences, permissions, and authorisations to use, reproduce, duplicate, and distribute the Materials.

You further warrant that the Materials do not infringe any copyright, trademark, performer rights, moral rights, privacy rights, publicity rights, or any other intellectual property rights of any third party.

8.2 Customer Responsibility

You are solely responsible for ensuring the legality of all Materials you submit.

DiskCrafters relies entirely on your representations and accepts Materials in good faith.

8.3 Continuing Effect of Warranties

All warranties and representations made by you survive completion, delivery, and fulfilment of your order.

9. No Duty to Investigate

DiskCrafters does not provide copyright clearance, licensing verification, or legal review services.

We are not responsible for reviewing, investigating, or verifying the ownership, legality, or licensing status of any Materials submitted.

We are entitled to rely fully on your representations without independent verification.

10. Prohibited and Unlawful Content

You must not submit any Materials that are unlawful, fraudulent, counterfeit, or infringe the rights of any third party.

This includes (without limitation) unauthorised copies of commercial music releases, films, software, or other copyrighted works where you do not hold the necessary rights or permissions.

We reserve the right to refuse any order that we reasonably believe involves infringing, counterfeit, or unlawful content.

11. Right to Refuse Orders

We may refuse, suspend, cancel, or delay any order where we reasonably believe the Materials may infringe intellectual property rights, violate laws, or expose DiskCrafters to legal, financial, or reputational risk.

We are not obligated to accept any order.

12. Post-Production Action

If we become aware of a potential intellectual property issue after production or delivery, we may take reasonable steps including suspending services, withholding future orders, or requesting that further distribution of materials cease where legally or practically possible.

13. Indemnity

You agree to indemnify, defend, and hold harmless DiskCrafters, its directors, employees, agents, and affiliates against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising from:

Any alleged or actual intellectual property infringement;
Your breach of these Terms;
Materials supplied by you; or
Any work carried out in accordance with your instructions.

14. Claims and Complaints

If we receive any claim or complaint relating to Materials you supplied, we can suspend production, withhold delivery, cancel orders, or disclose relevant information where required by law or reasonably necessary to respond.

15. Intellectual Property (DiskCrafters Content)

All non-customer content on our website and branding remains the property of DiskCrafters and is protected by intellectual property laws.

16. Marketing Use of Products

By placing an order with DiskCrafters, you grant us a non-exclusive, worldwide, royalty-free licence to use images, photographs, or video recordings of completed or in-production products for marketing and promotional purposes, including our website, social media channels, and advertising materials.

This may include showcasing examples of our work for portfolio and promotional purposes.

If you do not wish for your order or products to be used in this way, you must contact us before production begins to opt out. Where a valid opt-out request is received, we will not use identifiable images or media of your order for promotional purposes.

17. Limitation of Liability

To the fullest extent permitted by law, DiskCrafters is not liable for any indirect, incidental, or consequential losses, including loss of profits or data.

Total liability for any claim is limited to the value of the order.
